1. Overview and scope
This Acceptable Use Policy (the “AUP”) applies to everyone who uses the Thorbis platform, websites, mobile applications, and related services (the “Service”), and is part of the Terms of Service. Capitalized terms used but not defined here have the meanings given in the Terms.
The Customer is responsible for its Authorized Users' and its End Customers' compliance with this AUP to the extent they use the Service. You are responsible for use of the Service under your account, including by people you permit to use it and by automated features you enable.
The examples in this AUP are illustrative, not exhaustive — a use that is harmful, unlawful, or abusive can violate this AUP even if it is not listed. Thorbis may update this AUP from time to time, and the current version governs your use of the Service.
2. Prohibited content and conduct
You may not use the Service to store, send, process, or make available anything that is unlawful or that infringes or violates the rights of others. Prohibited content and conduct include, without limitation:
- content that is unlawful, infringing, defamatory, deceptive, fraudulent, harassing, threatening, abusive, or obscene;
- content that violates another person's privacy, publicity, intellectual-property, or other rights;
- malware, viruses, or other harmful, malicious, or destructive code;
- impersonation of any person or entity, or misrepresentation of your affiliation with a person or entity;
- any use that violates applicable export-control, sanctions, anti-corruption, or other laws or regulations.
3. Messaging and anti-spam
All SMS, MMS, and email you send through the Service must comply with applicable law and carrier rules, including the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and 10DLC registration and messaging requirements. This is one of the most important parts of this AUP.
- Do not send messages without the prior consent required by law for the type of message you are sending.
- Do not use purchased, rented, harvested, or otherwise non-consented contact lists.
- Honor opt-out and unsubscribe requests immediately, including replies such as STOP.
- Use accurate sender identity and include the identification and disclosures required by law and carrier rules.
- Do not send content that is prohibited or restricted by carriers — for example, content involving illegal activity, and carrier-restricted categories such as certain regulated or adult content.
You are solely responsible for consent
You — not Thorbis — decide who to contact, what to send, and when. The Customer is solely responsible for obtaining and maintaining the consent required for every message it sends through the Service, and for honoring opt-outs and applicable law.
4. Telephony and voice abuse
Voice calling through the Service must comply with applicable law. You may not use the Service for:
- unlawful robocalling or autodialing;
- unlawful caller-ID spoofing or falsifying caller identification;
- spam or high-volume nuisance calling;
- calling or call recording in violation of applicable laws, including any one-party or two-party consent requirements for recording calls.
5. Payments abuse
Payment and payout features must be used only for lawful, legitimate transactions. You may not use them:
- for illegal, prohibited, or high-risk businesses or transactions;
- for money laundering or for processing the proceeds of unlawful activity;
- for card testing or other fraudulent transaction activity;
- to evade the payment processor's rules or its prohibited-business list.
You must comply with applicable card-network rules and with the payment processor's agreement. Use of payment and payout features is also governed by the Payments & Money-Movement Terms.
6. AI and automation abuse
AI and automation features act on your instructions and under your accounts. You may not use them to:
- generate or send unlawful, infringing, deceptive, or harassing content;
- evade consent, opt-out, or rate-limit requirements that would otherwise apply to your communications or use of the Service.
7. Security and integrity
You must not interfere with, compromise, or attempt to gain unauthorized access to the Service or to others' accounts or data. Prohibited activity includes:
- unauthorized access to any systems, accounts, or data;
- probing, scanning, penetration testing, or vulnerability testing without our prior written authorization;
- circumventing rate limits, security measures, or access controls;
- scraping or automated bulk extraction of data from the Service;
- any action that overloads, disrupts, or degrades the Service or its infrastructure.
Report a vulnerability
If you discover a security vulnerability, report it to security@thorbis.com rather than testing it further. Good-faith reports are welcome.
8. Fair use and resale
Use the Service for your own business. You may not resell, sublicense, or otherwise provide the Service to third parties, or operate it as a service on behalf of third parties, except as expressly permitted in writing.
9. Enforcement
Investigation, suspension, and termination
Thorbis may investigate suspected violations of this AUP and may remove content, throttle, suspend, or terminate access — including immediately where necessary to protect the Service, other customers, or third parties, or to comply with law.
