1. Overview
Thorbis respects intellectual property rights and responds to clear notices of alleged copyright infringement under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.
This policy explains how to send us a takedown notice, how we respond, and how to send a counter-notice if your material was removed by mistake.
2. Filing a takedown notice
To report material you believe infringes your copyright, send a written notice to our designated agent at dmca@thorbis.com that includes all of the following:
- Your physical or electronic signature.
- Identification of the copyrighted work claimed to be infringed.
- Identification of the allegedly infringing material and information reasonably sufficient to locate it (such as a URL).
- Your contact information, including your name, address, telephone number, and email address.
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorized to act on the owner's behalf.
3. Our response
Upon receiving a valid notice, we may remove or disable access to the material and will take reasonable steps to notify the affected user.
We reserve the right to terminate, in appropriate circumstances, the accounts of users who are repeat infringers.
4. Counter-notice
If your material was removed and you believe it was a mistake or misidentification, you may send a counter-notice to dmca@thorbis.com that includes all of the following:
- Your physical or electronic signature.
- Identification of the material that was removed or disabled and the location at which it appeared before it was removed or disabled.
- A statement, made under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number; a statement that you consent to the jurisdiction of the appropriate federal court; and a statement that you will accept service of process from the party who filed the original notice.
After we receive a valid counter-notice, we may restore the removed material in 10 to 14 business days unless the party who filed the original notice first notifies us that they have filed a court action seeking to restrain the allegedly infringing activity.
5. Misrepresentations
Knowingly false notices carry liability
Under 17 U.S.C. § 512(f), a person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake, may be liable for damages — including costs and attorneys' fees.
